The short answer
A DMV release of liability, also called a notice of sale or transfer notification, is a short form telling your state's motor vehicle agency that you sold or junked a car. It helps protect you from the buyer's tickets and tolls. Deadlines vary: 5 days in California and Washington, 30 in Texas and Florida.
A DMV release of liability is your report to the state that you sold the car, when and to whom. It puts a date of sale on the state's record, so tickets, toll bills and towing charges from after that date stop pointing at you.
If you're selling a junk car, the same rule applies. A sale to a junkyard or a junk car buyer is still a sale.
What is a release of liability?
A release of liability is the seller's notice to the motor vehicle agency that a vehicle has been sold or transferred. States give it different names. California calls it the Notice of Transfer and Release of Liability (NRL), Texas the Vehicle Transfer Notification, Washington the Report of Sale, and Florida the Notice of Sale (form HSMV 82050).
The form is short. California's asks for the new owner's name and address, the plate number, the last five digits of the VIN and the odometer reading at the sale (CA DMV). It doesn't retitle the car. In California's words, filing an NRL "does not qualify as a transfer of ownership," so the buyer still has to complete the transfer and pay the fees.
The phrase "release of liability" also names the waiver you sign at a gym or a trampoline park. This guide is about the vehicle form.
Why does a release of liability matter?
Until the buyer retitles the car, your name can stay on the state's record, and notices for that car go to the owner on record. Texas warns that a sale that isn't transferred properly could leave the seller responsible for tickets, toll violations or even crimes committed with the vehicle (TxDMV). Filing the notice is how you draw the line:
- In California, once the DMV receives the NRL, liability for parking violations, traffic violations or civil litigation after the date of sale becomes the buyer's.
- In Texas, if you file within 30 days of the sale, you can't be held responsible for parking tickets and toll violations the buyer commits.
- In Washington, the Report of Sale protects you from towing charges and from civil and criminal liabilities the new owner incurs (WA DOL).
- In Florida, if the buyer never retitles and you didn't file HSMV 82050, you can be held liable for actions associated with the car even though you no longer own it (FLHSMV).
The same goes for junk cars. Some junk and salvage yards hold vehicles for months or years before the car is crushed, sold or rebuilt, according to the Justice Department's NMVTIS program. A dated notice on file covers you for that whole stretch.
Do you need to notify the DMV if you junk your car?
Yes, if your state has a notice-of-sale rule, because selling a car to a junkyard or a junk car buyer counts as a sale. Washington's list of cases that require a Report of Sale includes "Give to a wrecking yard" and "Dispose of your vehicle." California's 5-day rule applies whenever you sell or transfer the title or your interest in the car and hand it over to another owner.
Don't count on anyone else to file it for you. Washington says that even when a dealer files on your behalf, it's the owner's responsibility to confirm the report was submitted.
How do you file a release of liability?
Many states let you file online, and some also take the form by mail or in person. Some print the form on the title itself, as Alaska and Hawaii do. The steps usually look like this:
- Before the buyer leaves, write down the buyer's name and address (for a junk car buyer, the company's), the date, the price and the odometer reading.
- Note the plate number and the VIN.
- File before the deadline. California's online NRL, Texas's Vehicle Transfer Notification and Washington's Report of Sale are all online, and California says an electronic NRL updates the vehicle record within 1 business day. California also takes the paper form, REG 138, by mail. In Florida, form HSMV 82050 goes to your local tax collector's office.
- Save the confirmation, along with a photo of the signed title and your bill of sale.
Get the details right. Washington says that if you find an error after filing, you'll have to visit a vehicle licensing office, and the report will be deleted so you can file a new one.
Which states have a notice of sale, and what are the deadlines?
The table covers the states whose rule we've checked against the agency's own page, with the form name and deadline that page gives. "No deadline stated" means the agency page we checked doesn't set one, and we didn't find one in the state's statutes either. If your state isn't listed, it may still have a rule we haven't confirmed, so check with its motor vehicle agency. The exact sentence behind each row is on our sources page.
| State | What it's called | Deadline |
|---|---|---|

Where there's no deadline, file the day of the sale anyway. The sooner the record shows the date, the less room there is for a dispute.
What if your state doesn't have a release of liability?
If your state has no seller's notice, make your own paper trail and keep it:
- A bill of sale with the date, the price, the VIN, and the buyer's name and address, signed by both of you. Texas advises sellers to keep detailed written records of any sale, including the buyer's contact information, the date and the VIN.
- Photos of the front and back of the signed title, taken before you hand it over.
- The plates, if your state keeps them with the owner. In New York, for example, the plates stay with the seller, who either moves them to another vehicle or surrenders them to the DMV.
- Proof of payment, such as a copy of the check or a receipt.
Cancel the insurance only after the plates are handled, since some states tie the two together. Our checklist for before you junk your car covers the rest of the pickup-day details, and the step-by-step guide to junking a car puts this paperwork in order with everything else.
What if you get a ticket after you sold the car?
Send proof of the sale to whoever issued the ticket or toll bill: your notice-of-sale confirmation, the bill of sale and the photo of the signed title. In Texas, if tickets or tolls still arrive after you filed, the state says you can ask TxDMV for a confirmation email or submit a Request for Texas Motor Vehicle Information (Form VTR-275) showing the month and year the vehicle was transferred.
If you never filed, file now and keep the confirmation with the rest of your proof of sale.

Frequently asked questions
Does a release of liability transfer the title to the buyer?
No. It records that you sold the car and when. The buyer still has to apply for a title in their name. California's DMV says filing its release of liability does not count as a transfer of ownership.
Who signs a release of liability?
The seller. Florida's form HSMV 82050 says the seller completes the notice-of-sale sections, the buyer's signature is optional, and there's a line for a co-seller when there is one. Delaware's Seller's Report of Sale asks for the buyer's name and address, the date and hour of the sale and the seller's signature (Delaware DMV).
How long do I have to file a notice of sale?
It depends on the state. California and Washington give you 5 days; Oregon, Hawaii and Minnesota 10; Louisiana 15; and Texas, Florida, Missouri and Wisconsin 30. Some states set no deadline, and a few make the form optional. Our sources page has the exact wording for each state we've checked.
What address do I use if I sold to a junk car buyer or dealer?
Use the buyer's business name and address, as they appear on your bill of sale or receipt. Ask for that paperwork before the car leaves, and copy the details exactly so your notice matches it.
Can I file a release of liability online?
In many states, yes. California, Texas and Washington all take it online, and California says an electronic filing updates the vehicle record within one business day. Keep the confirmation.
Do I still need to file if a junkyard bought my car?
Yes, where your state has a notice-of-sale rule. Washington, for example, lists giving a car to a wrecking yard as a case that requires a Report of Sale. Ask the buyer for its business name and address so you can fill in the form.
